1 Registration and personal data
Placing an order in the online shop does not require registration. By registering to the online shop, you can make your purchases faster and view your orders. The e-mail address used for registration serves as the Customer’s username. The password is set by the Customer upon registration. Usernames and passwords are personal. The Customer is responsible for maintaining the confidentiality and security of their username and password. The Customer is responsible for any activities that occur in their account and any costs arising from them.
The Customer must provide the information needed to use the online shop services. The City of Kokkola is entitled to handle the Customer’s personal data in accordance with the Personal Data Act and other Finnish legislation. Customer data will be stored in the customer register of the online shop. The City of Kokkola will not disclose the Customer’s personal data to third parties for the purposes of direct advertising, distance selling or other direct marketing. Customer data will be removed from the customer register when it is no longer needed.
2 Placing an order
Products are mainly ordered via the Internet at verkkokauppa.kokkola.fi, through a shopping cart. All orders are confirmed by e-mail, indicating the price of the order, the delivery costs and the ordered products. Order confirmation requires providing an e-mail address when ordering. By making the payment, the Customer agrees to follow the online shop’s Terms of Use and Delivery that are valid at the time of the order as well as the special terms applying to the product ordered.
3 Payment methods
The products must be paid for when placing the order. Online payments take place via a secure connection via the Suomi.fi/Paytrail service. Orders can be paid for by using Finnish banks’ online payment systems and Nets Oy’s credit card payment service (Visa and MasterCard) as well as MobilePay service.
4 Prices and value added tax
For online orders, the valid price is the price shown in the online shop at the time of the order. The City of Kokkola reserves the right to change prices. All prices are shown in euros (EUR). The product prices in the online shop include value added tax currently in force.
5 Returns
The cash balance will be uploaded to the Ceepos Mobile app immediately after payment. The loaded balance is unrefundable, but it can be used at any point-of-sale that uses Ceepos mobile payment.
6 Service maintenance, usability and error conditions
The City of Kokkola will make every effort to ensure that the online shop functions smoothly and uninterrupted. The City of Kokkola is entitled to interrupt the online shop activities due to the following circumstances: a change or redesign of the service, a related technical reason, the installation, maintenance or repair of the data communications network or any similar reason and when required by law or other official regulations. The aim is to schedule interruptions so that they do not cause any undue disruption to the Customer.
The City of Kokkola is not responsible for errors due to interruptions in data communication links or other data communications provided by a third party or to flaws in such services. In addition, the City of Kokkola is not responsible for errors arising from using the online shop in violation of instructions or regulations or errors that have otherwise been caused by the Customer.
7 Data security
The online shop is SSL secured. The Customer is responsible for ensuring appropriate data security in the Customer’s own information systems. The City of Kokkola shall keep all data concerning or submitted by the Customer confidential. The City of Kokkola maintains the security of its online shop in a generally acceptable and efficient way and seeks appropriate technical solutions to prevent unauthorized access to its data systems.
8 Equipment, software and connections
The Customer is responsible for the purchase, functionality and costs of the equipment, software and network connections required to use the online store itself. They shall not cause interference or other harm to the online shop or other network users.
9 Liability for damages
The City of Kokkola is only liable to the Customer for the direct damage caused by negligence by violating the agreement. If it can be established that the City of Kokkola is at fault, the Customer may be reimbursed for costs unduly charged from the Customer by the online shop.
The City of Kokkola is not liable to pay damages or other direct or indirect reimbursement or compensation due to disturbances or defects specified in section 6.
10 Force majeure
If affected by a force majeure event that prevents transactions in the online shop or makes them excessively difficult, the City of Kokkola will not be liable for any obligations related to the online shop. A force majeure event includes fire, earthquake, flood, explosion, strike or other labor disturbance, regulation of the authorities, disruption in the energy supply, shortage of raw materials or supplies, cable or other communications disturbance caused by or resulting from a third party, or other similar reasons, of which the service provider was unaware and for which it could not reasonably be prepared for in advance. If possible, the City of Kokkola will report any force majeure on its website immediately after the event has occurred.
11 Amendment of Terms of Use and Delivery
The City of Kokkola is entitled to amend these Terms of Use and Delivery of the online shop after notifying of the changes in the online store well before the changes enter into force.
12 Resolution of disputes
Any disputes concerning this agreement will be resolved in the Ostrobothnia District Court in accordance with the Finnish law.
